Well, it is very hard to "punish developers" in a non-subscription game. They already have our money remember. No skin off their nose if you never set foot in game again really.

I would be very surprised if they sell many more copies of EC on PC format anyway, so where else are they getting any more cash from? I doubt very much people are throwing money at the cash shop given its appalling setup and what is actually for sale in the 1st place. Also, there are not 1000s playing the game anyway.

That is after all what TOS strive to do in the form of 100 page essay on trying to worm their way out of any legal obligation. Yes, but you guys seem to be ignoring that improvements that happened between then and now versus when it was in alpha. It is past alpha, but it may as well be considered an open beta now. Just cause it isn't in early access doesn't mean it still isn't getting worked on, mostly since a lot of work has been done on it. They did however make a huge promise to do some pretty radical stuff for a game, and like I said the only game I know that did something like that was planetside. I would love for t hem to succeed, however I ain't getting my hopes up for them to anything far beyond what APB accomplished honestly.
